Twenty-five defendants, doctors, pharmacists, presidents of veterans' societies or simple employees, were brought before the courts after a six-month investigation. The lawyers for the accused are determined, it is said at the courthouse, to use all legal means to prevent the case from being judged on its merits in Marseille. They asked the Court of Cassation for referral to court on grounds of legitimate suspicion. They propose, moreover, if their appeal has not been admitted by Wednesday, to file at the start of the hearing, conclusions of incompetence of the criminal court, based on this fact that the investigation noted forgeries (falsely signed orders or slips) and that, consequently, the Assize Court has sole jurisdiction. In the event of rejection of these conclusions of incompetence, a legal suspensive appeal, lodged before the Aix Court of Appeal, would interrupt the course of the trial.
